ER Card Terms of Use Agreement

1. Your agreement with ER Card LLC
Your use of ER Card electronic personal health record (ePHR) service is governed by this agreement. ER Card information is self-reported by you, or any authorized individual who may be responsible for your care, and will provide healthcare professionals with the important information they need to diagnose and treat you in both emergency and routine care situations.
2. Registration and Ordering
Online visitors to the ER Card website: www.ercardmember.com will be asked to provide name, mailing address, telephone number, date of birth, e-mail address, and credit card information to enroll in the ER Card service. A family membership requires a parent or legal guardian to provide the name and date of birth for minor/dependent children. Only one email address is required for couples/family memberships. Once you submit the registration form to ER Card, you are automatically assigned a membership identification number, user name and password for online access to your electronic personal health record (ePHR). The first time you login, you will be asked to change your password. Choosing a password is your responsibility and will help you keep your ePHR private and secure.
Membership in ER Card and your acceptance of our Terms of Use, authorizes us to release all personal health information you or your representative have provided, to any healthcare providers – physicians, nurses or EMTs who need to treat you. Such disclosure may be made by web, phone, fax or email to authorized individuals.

Updating Information
ER Card members can view, edit, save, print or delete their personal health information anytime through our secure website: www.ercardmember.com. Care Managers are also available to assist you and can be reached by calling 888-973-2673. Any changes will be reflected immediately upon entry with a date/time stamp for easy reference.
In the interest of serving you better and identifying potential security violations, ER Card Management review internal reports of all member records accessed by healthcare professionals in the last 24 hours. We can assist with follow-up care to emergency events, provide support or referrals for services and interventions, or simply update your personal health record to reflect your recent care. Care Managers and staff Pharmacists routinely access member records in the event of a medication or medical device recall, assist with semi-annual/annual updates and to offer preventative care reminders.
ER Card sends electronic newsletters on a monthly basis to members and we may also send email communications related to web site updates, new product releases or general health topics. To opt-out of our electronic communications, select the opt-out button associated with the specific communication. If you opted out of all communication with the site, or deleted/de-activated your account, then you will not be contacted.
4. Access to Records
ER Card members have access to personal health records through our secure website anytime. You can provide a paper or electronic copy of your ePHR report to anyone you choose, typically your physician. ER Card medical operators provide 24/7 phone care support and will report a members health information to authorized care providers who call the 800 number on your membership identification card. Many hospitals have been assigned a user name and password to access ER Card member’s information and EMTs also have access to patient information through lap top computers on rescue vehicles. ER Card will not be liable for unintentional disclosure of your personal health information due to errors in transmission or unauthorized acts of third parties.
5. Termination of ER Card
ER Card may suspend or terminate your use of ER Card personal health record service if you fail to comply with this agreement or fail to pay the necessary fees associated with the service. This suspension or termination will de-activate your record and may delete your information, files and other previously available information.
At any time, you can opt out of any service you have been using and revoke your authorization to release information and for our access to your information, by calling 888-873-2673 and requesting the appropriate ER Card Termination form. Once you have opted out of all communication with the site, or deleted/de-activated your account, you will not be contacted. No information you provided previously will be available to you or your care providers.
6. Additional Terms
Your use of ER Card is subject to each of the terms outlined in this agreement and the ER Card Privacy Policy.
7. Revisions to our Terms of Use Agreement
We reserve the right to change this agreement at any time and will the post our revised Terms of Use Agreement on our website: www.ercardmember.com and the date the agreement was last revised will always appear at the top of the policy pages. Your continued use of ER Card after the date the revised agreement is posted will constitute your acceptance of the revised agreement.
9. Intellectual Property Rights
All of the content of this website, including text, art, graphics, logos, images, pictures, audio/video clips and software is the property of ER Card LLC (ERC), and is protected by U.S. and international copyright laws. Any use of such content, including modification, transmission, presentation, distribution, or republication is prohibited without the express prior written consent of ERC.
All trademarks, trade names, logos, brand names, and service marks of ERC whether registered or unregistered, are the property of ERC and are protected by U.S. and international trademark laws. Any use of these assets is prohibited with the express prior written consent of ERC. In no event may any such assets be used in connection with any product or service that is not ER Card’s, in any manner that is likely to cause confusion or in any manner that disparages or discredits ERC. Any other trademarks, trade names, brand names, company names and/or logos appearing on this web site are the property of their respective owners.
All patents and patent applications of ERC are the property of ERC and are protected by U.S. and international patent laws. Any use of these patented or patentable assets is prohibited without the express prior written consent of ERC.
Subject to this Terms of Use Agreement, ERC grants you a limited, personal, revocable, non-assignable, non-exclusive license to use ER Card.
10. Entire Agreement
This Terms of Use Agreement and all other legal notices (including but not limited to the Privacy Policy) posted by ER Card LLC on this website, constitute the entire agreement between you and ER Card LLC with respect to the use of the ER Card website, products and services.
